Website and Service Terms
Terms and Conditions
The terms governing access to DKINC Global websites, SaaS platforms, digital products and services.
Effective and last updated: 5 October 2026
1. Contracting entity
These terms are issued by DKInc Digital India Pvt. Ltd., CIN U74999TN2021FTC142227, GSTIN 33AAICD3901G1Z2, with registered office at Plot No. 87, 1st Floor, 4th Cross Street, Thirumalai Nagar, Perungudi, Chennai, Tamil Nadu 600096, India. “DKINC,” “we,” “us” and “our” refer to this entity unless an order expressly identifies another seller.
2. Acceptance and affirmative consent
By creating an account, placing an order or using a service, you agree to the terms presented for that transaction. Purchase consent must be an explicit affirmative action; we do not rely on pre-ticked acceptance. If you do not agree, do not complete the purchase or use the service.
3. Eligibility and accounts
You must have legal capacity to contract and provide accurate information. A person acting for an organization confirms authority to bind it. You are responsible for account security and activity performed with your credentials. Notify us promptly of suspected unauthorized access. Never share passwords, OTPs, card PINs, UPI PINs or CVVs.
4. Product information and orders
We aim to provide accurate descriptions, eligibility requirements, material limitations, delivery estimates and total prices. An order is accepted when we issue confirmation or activate delivery. We may reject or cancel an order affected by a genuine pricing error, illegality, sanctions, suspected fraud, technical impossibility or unavailable capacity; any captured amount will be refunded.
5. Prices, taxes and payment
The final checkout must show the total payable amount, tax and every compulsory or optional charge before authorization. The checkout identifies the methods then available, which may include UPI, cards or net banking, and any method-specific fee. DKINC does not request or store UPI PINs, card PINs, CVVs or OTPs. Payment-provider terms also apply to the payment service itself. Where PhonePe is displayed as the provider, customers may use PhonePe's grievance channel for payment-provider issues after first checking the order status with DKINC.
6. Subscriptions and renewal
Where recurring billing is offered, the price, billing frequency, renewal mechanism and cancellation method will be disclosed before consent. You may cancel future renewal without a cancellation penalty. Cancellation and refund eligibility are governed by the Cancellation, Return and Refund Policy.
7. Permitted use
You may use the service for lawful purposes within documented limits. You must not interfere with security, probe systems without authorization, misuse personal data, transmit malware, evade limits, infringe rights, impersonate others, resell access without permission, or use the service for unlawful, deceptive, abusive or discriminatory activity.
8. Customer content
You retain ownership of content you submit. You grant DKINC a limited licence to host, process, reproduce and transmit it only as reasonably necessary to provide, secure and support the service and comply with law. You represent that you have the rights and lawful basis needed to submit it.
9. Intellectual property
DKINC and its licensors retain rights in software, designs, trademarks, documentation and platform content, excluding customer content. Except for the limited right to use a purchased service, no ownership is transferred. Feedback may be used without restriction provided it does not disclose confidential information.
10. Third-party services
Some functions depend on payment providers, communications networks, cloud services or linked websites. Their terms and privacy practices apply to their services. We remain responsible for obligations that law places on DKINC and do not disclaim responsibility merely because a subcontractor is used.
11. Availability, maintenance and changes
We aim for reliable service but do not promise uninterrupted availability unless a written service level agreement says otherwise. We may perform maintenance and make proportionate changes for security, law, compatibility or improvement. Material adverse changes to a paid service will be notified where reasonably practicable and may create cancellation rights.
12. Suspension and termination
We may suspend access where reasonably necessary for security, non-payment, illegality, material breach or protection of users. Where feasible, we provide notice and an opportunity to cure. Termination does not remove accrued payment obligations or rights that must survive. Refund consequences are determined under the refund policy and applicable law.
13. Informational services
Astrology, wellness, educational and general informational content is not a substitute for licensed medical, legal, financial or other regulated professional advice. Customers should obtain appropriate professional advice for decisions requiring it. This clause does not excuse inaccurate processing or misleading descriptions.
14. Warranties and liability
Services will be provided with reasonable care and skill and substantially as described. To the extent permitted by law, implied warranties not capable of applying to digital services are excluded. Neither party is liable for indirect or consequential loss that was not reasonably foreseeable, but nothing excludes liability for fraud, wilful misconduct, personal injury caused by negligence, breach of confidentiality/data-protection duties, or any consumer liability that cannot legally be excluded.
15. Indemnity for unlawful use
You are responsible for direct third-party claims caused by your unlawful content, infringement or deliberate misuse, subject to prompt notice and a reasonable opportunity to respond. This does not apply to claims caused by DKINC.
16. Governing law and disputes
These terms are governed by Indian law. Courts with lawful jurisdiction in Chennai, Tamil Nadu may hear disputes, subject always to mandatory consumer-forum jurisdiction and any non-waivable rights in the consumer's residence. Before formal action, either party may request good-faith resolution through the grievance process.
17. Changes and contact
Material changes apply prospectively and will be dated here. Continued use after notice constitutes acceptance only where legally valid; a material change does not retrospectively remove an accrued right. Contact contact@dkincglobal.com or use the contact form.
